Some Provisions of Federal Gift Card Rule Delayed for Cards Issued Prior to April 2010
As we mentioned in
March, the Federal Reserve issued a final rule implementing the Federal CARD Act and regulating gift certificates, store gift cards, and general-use prepaid cards. On August 11, the Federal Reserve issued an
Interim Rule that delays the effective date of certain disclosure requirements to January 31, 2011, for certificates or cards produced prior to April 1, 2010. This change was mandated by enactment of the ECO Gift Card Act
H.R. 5502 which was supported by the stored value card industry so that card issuers could use the millions of cards already produced rather than destroy them to comply with the new federal rule.
